ICO Registration CertificateDavey Site Services require your permission to keep relevant details of employment for present and future use via a signature on the New Employee Details form. Details given are treated as your property and all information belongs to you. These details will not be shared or amended without your prior consent and remain confidential and protected whilst being stored. The storage and use of information will be compliant with new GDPR guidelines, which replace the Data Protection Act of 1998. Please refer to the DSSL Company Manual and/or DSSL GDPR Company Policy for further information. Clients and customers provide bank details consensually to ensure present and future payments are processed without disruption.

You may view or amend your records by submitting a "Subject Access Request". Upon receipt of the request we will endeavour to respond within thirty days. Information which could potentially be in breach of the data protection to others can be withheld. The Information Commissioners Office may help if you have been refused access to your information. You have the right to request the erasure of personal details if no longer required for business purposes if you so wish.

We may change this privacy notice from time to time in order to reflect changes in the law and/or our privacy practices. We have a dedicated data protection processor. You can contact the data processor by writing to the above address, marking it for the attention of Nina Bryson.

What kinds of personal information do we process?

Personal information that we’ll process in connection with your business or employment or any related documentation may include:

  • Personal and contact details, such as title, full name, contact details and contact details history.
  • Your date of birth, gender and/or age.
  • Citizenship status, such as your nationality, and/or your length of residency in the UK and/or whether you have the permanent right to reside in UK.
  • Family members, next of kin (if relevant for Welplan Insurance purposes).
  • Information about your health via our medical questionnaire.
  • Your marital status.
  • Tax information, National Insurance number and previous employer P45.
  • Work history with the company, including site locations and rates of pay.
  • Bank details

What is the source of your personal information?

We’ll collect personal information from the following general sources:

  • From you directly, via forms completed by yourself in the "New Starter Information Pack" which is given on commencement of employment.
  • From you directly via a curriculum vitae, if submitted
  • From you directly via invoice or statement.
  • From other sources such as HMRC, DWP or any other official organisation relevant to employment.

What do we use your personal data for?

We use your personal data, including any of the personal data listed above, for the following purposes:

  • Updating your records so that only correct and relevant information is used.
  • To improve the operation of our business by following guidance and best practice under the change to rules of governmental and regulatory bodies.
  • For management of our employees for business operations.
  • To keep records of our communications with you and other staff.
  • To comply with legal and regulatory obligations, requirements and guidance.
  • To share information, as needed, with HMRC, Department of Work and Pensions, Welplan Insurance, Welplan Pensions and any other official organisation relevant to employment, Thomas Carroll (Brokers) Ltd.
  • For contact purposes so we may get in touch should any future contracts require your trade/skill.
  • For payment purposes.

What are the legal grounds for our processing of your personal information?

We rely on the use your personal data where it is in our legitimate interests to do so, such as:

  • To follow guidance and recommended best practice of government and regulatory bodies
  • For management and audit of our business operations including accounting.
  • To keep records of our communications with you.
  • Where we need to share your personal information with people or organisations in order to run our business or comply with any legal and/or regulatory obligations.
  • To comply with legal obligations.
  • Possible future industrial insurance claims brought against the Company retrospectively. Such claims may require information dating back several years. Certain claims have no time limit or deadline to which a claim can be made (eg; sight or hearing).

When do we share your personal information with other organisations?

We may share information with the following third parties for the purposes listed above:

  • Governmental and regulatory bodies such as HMRC, The Information Commissioner’s Office, Welplan Insurance and Pensions.
  • Thomas Carroll Business Insurance.

How and when can you withdraw your consent?

You may request the removal and destruction of your information which is no longer required by the Company for legal purposes by writing to the above address, marking it for the attention of the Data Processor. DSSL will respond to such a request within 30 days of receipt. In special circumstances, the response can be extended to two months.

Is your personal information transferred outside the UK or the EEA?

We are based in the UK and as such do not transfer information outside of the UK. If the company becomes engaged in a contract overseas, your personal information may be transferred outside the European Economic Area. If this situation arises, we will ensure that suitable safeguards are in place, for example by using approved contractual agreements.

What should you do if your personal information changes?

You should tell us so that we can update our records by using the contact details shown at the top of the page.

Do we do any monitoring involving processing of your personal information?

In this section monitoring means keeping records of any calls, email, in person (face to face) meetings and other communications when necessary. We will do this where the law requires it, or to comply with regulatory rules and procedures. This information may be shared for the purposes described above.

For how long is your personal information retained by us?

Unless we explain otherwise to you, we’ll hold your personal information based on the following criteria:

  • For as long as we have reasonable business needs, such as managing our relationship with you and managing our business.
  • For as long as it is possible for a potential legal or insurance claim to be made against us. (Certain degenerative claims have no time limit).
  • Retention periods in line with legal and regulatory requirements or guidance.
  • We will retain business information for as long as there is a business connection.
  • We will only remove this information when you instruct us to do so.
